Duties, Powers and Liabilities
a) Render legal opinions on matters pertaining to the duties of the Supreme Council and its organization, in accordance with the instructions issued by the President of the Supreme Council.
b) Engage in legislative activities within the scope of the Supreme Council's mandate, review secondary regulations for conformity with applicable law, propose amendments to existing legislation, monitor legislative developments, and duly inform the President, members of the Supreme Council, and relevant administrative units in a timely manner. To provide legal opinions on draft laws, decrees, and regulations prepared by other authorities and submitted to the Supreme Council for review.
c) Assist the Supreme Council in the performance of its duties by conducting legal research and providing legal advice, as necessary, and to participate in commission work when required.
ç) Provide legal opinions on matters as deemed necessary by the Supreme Council and its President.
d) Upon the directive of the President of the Supreme Council, to issue legal opinions on matters that may have legal, financial, or criminal ramifications for the units, after consulting with the relevant unit and reviewing the available information and documentation concerning such matters.
e) Manage legal proceedings between third parties and the Supreme Council, initiate legal actions as necessary in relation to the Supreme Council’s duties, and represent the Supreme Council and its organization in lawsuits and enforcement proceedings filed against the Supreme Council.
f) Prepare and transmit responses to notifications, warnings, and demands received from judicial and administrative courts, enforcement agencies, and notaries, or to ensure compliance with legal requirements, or to forward such notifications to the relevant units for action. To ensure that all court decisions are duly annotated with the date of service and submitted to the Supreme Council within the prescribed time limits.
g) Upon authorization from the Supreme Council to initiate lawsuits within the prescribed time limits, to provide timely responses to lawsuits filed against the Supreme Council, to file responses to counterclaims, to challenge expert opinions, to file appeals against decisions made by the courts against the Supreme Council within the prescribed time limits, and to request the rectification of any such decisions where appropriate. To exercise the utmost diligence in the conduct of all legal proceedings and to report progress to the Supreme Council on a monthly basis.
ğ) Provide advisory legal opinions on contracts, agreements, and protocols as required.
h) Propose the discontinuation of legal actions deemed unnecessary for appeal before higher courts.
ı) Carry out the necessary actions for the payment of legal expenses and attorney fees from the Supreme Council's budget for cases involving the Supreme Council members or the President, including proceedings commenced after their departure from office, in instances where such cases are pursued by attorneys designated under power of attorney at the request of the concerned parties.
i) Carry out the necessary procedures for the service of penalty decisions issued by the Supreme Council.
j) Perform such other duties as may be assigned by the Supreme Council or the President of the Supreme Council.
